Terms and conditions

Not a watertight contract in legal language, but the agreements as they are. By creating an account you agree to them.

This is a translation, provided so you can read what you are agreeing to. The Dutch text is the binding version; if the two differ, the Dutch text applies. Nederlandse versie.

1. What Ketenpas is

Ketenpas is provided by Omegaform, registered with the Dutch Chamber of Commerce under number 77453999, VAT ID NL003195678B53. Where this text says “we”, that is Omegaform.

Ketenpas is an online service with which you record the state of your organisation's security, share that with customers through a passport, and have customer questionnaires filled in based on your own answers. The scan gives an indication based on what you fill in yourself. It is not an audit, not a certification and not legal advice, and a score is no guarantee that your security is in order.

2. Your account

You sign in with a link by email. That link is personal; whoever can reach your mailbox can reach your account, so securing that email address is up to you. An account belongs to an organisation, and what you record belongs to that organisation.

3. Your answers remain your responsibility

What you fill in during the scan, what appears on your passport and what ends up in an answered customer questionnaire goes to your customers under your name. The questionnaire answering feature produces drafts that you are expected to review before you send anything. An incorrect answer towards your customer is and remains your responsibility, even if it came out of our software as a draft.

4. The passport

You decide what you share and with whom. Anyone holding the link to a passport can view it; that is what a share link is for. You can withdraw a passport at any time, and it expires by itself after a year.

5. Prices and payment

Current prices are on the pricing page. Paid plans run per month, excluding VAT. You pay the first month with iDEAL and thereby give a direct debit mandate; the months after that are collected automatically through our payment provider Mollie. You can cancel monthly; collection then stops immediately and you never pay beyond the current period. If a collection fails, your account falls back to the free plan after the paid period. Your data is simply kept; only the paid features close.

6. Fair use

The service is meant for answering your own customer questionnaires and managing your own supply chain. Anything reasonably outside that, such as automatically scraping the service or sending invitations to people who are not your suppliers, is not allowed. In case of misuse we may close an account; we will not do so without warning, unless there is no other way.

7. Availability and data

We do our best to keep the service available and fast, but we do not guarantee an availability percentage. An encrypted backup of the database and your files is made every night. If you stop, you can request your data before having your account deleted.

8. Liability

Our liability is limited to the amount you paid us in the twelve months preceding the event. We are not liable for indirect damage, such as lost revenue or a lost tender, or for decisions your customer makes on the basis of your passport or your answers. This limitation does not apply where the law does not permit it.

9. Changes

These terms may change. In the case of a material change we will say so when you sign in, at least a month before it takes effect. If you do not agree, you can cancel before the change takes effect.

10. Governing law
